1. APPROVAL AND ACCEPTANCE OF THE AGREEMENT
By registering, creating an account, or utilizing any module of the cloud-based CRM, ERP, Accounting, and Management software ("System") provided by REMUKAN SOWTWARE ("Company"), you declare that you have read, understood, and legally agreed to these "Terms of Use".
2. SCOPE OF SERVICE AND LICENSE NATURE
2.1. The Company provides software infrastructure operating on a subscription (SaaS) model, accessible via web browsers and API services without requiring physical hardware or local server deployment.
2.2. The right granted to the user does not transfer source codes, intellectual property, or copyrights. It solely grants a "Temporary, Non-Exclusive, and Non-Transferable Right of Use" during the subscription term.
3. USER DECLARATIONS AND OBLIGATIONS
3.1. Data and Content Responsibility: The User is solely responsible for the accuracy and legality of all customer data, commercial records, quotes, invoices, and financial entries logged into the system. The Company does not audit user entries and accepts no legal or financial liability for disputes with third parties.
3.2. Account Security: The User is responsible for safeguarding credentials. The Company shall not be liable for data breaches or damages arising from weak passwords or unauthorized sharing.
3.3. System Abuse: Unauthorized penetration attempts, reverse engineering, decompilation, malicious bots, or attempts to overwhelm server infrastructure (DDoS) are strictly prohibited. Violations lead to immediate termination and legal prosecution.
4. SERVICE CONTINUITY AND UPTIME
The Company undertakes necessary technological precautions for 24/7 cloud availability. However, the Company cannot be held liable for momentary disruptions caused by internet service providers (ISPs), global backbone failures, data center outages, force majeure, or planned maintenance.
5. BACKUP AND DATA LOSS
Data is periodically backed up against server hardware failures. However, no recovery guarantee is provided for data intentionally or accidentally deleted by the User's personnel. Users are advised to archive critical data using built-in export features (Excel, PDF, API).
6. TERMINATION AND SUSPENSION
The Company reserves the right to suspend or terminate accounts without prior notice if the User breaches these terms, engages in illegal activities, or defaults on subscription payments.
